End User License Agreement & Terms of Service

1. Agreement Overview

This End User License Agreement ("EULA") and Terms of Service ("TOS") constitute a legally binding agreement between you (the "User") and Feral Frequencies Media LLC ("the Company") regarding your use of any software published by the Company, including but not limited to SMDB Companion, EmbedaData, PTHKD, and the FeralFreq REAPER Extension (each, "the Software"). By downloading, installing, or using the Software, you agree to be bound by these terms.

2. License Grant

The Company grants you a non-exclusive, non-transferable, revocable license to use the Software for personal or commercial purposes, in accordance with the terms of this EULA. This license is granted for a single individual user only and does not permit use by a company, organization, or multiple users. If you require a license for multiple users or a facility-wide license, please contact [email protected] for details. Such licenses are not covered by this EULA and must be obtained separately.

3. Restrictions

  • Reverse engineer, decompile, or disassemble the Software.
  • Redistribute, sublicense, or sell the Software.
  • Use the Software for any unlawful purposes or in violation of applicable laws.

4. Payment Terms

Sections 4 and 5 apply only to Software the Company offers for sale. Software distributed at no cost, including beta and pre-release builds, is licensed under the remaining sections of this EULA without payment or registration.

  • All purchases of the Software are handled through Stripe. Upon successful payment, the Company will provide you with a registration code via email.
  • The purchase is non-refundable, except where required by law.
  • The Company reserves the right to adjust pricing at any time without prior notice. However, changes will not affect any already-completed transactions.

5. Registration and Activation

  • To use the Software, you must activate it using the registration code provided after purchase.
  • You are responsible for safeguarding your registration code and preventing unauthorized use.
  • Each license is tied to a single user and may not be shared or transferred.

6. Updates and Support

  • The Company may provide updates or upgrades to the Software at its discretion. Access to updates may be contingent upon compliance with this EULA.

7. Intellectual Property Rights

The Software and all related intellectual property rights remain the exclusive property of the Company. This EULA does not grant you ownership of the Software.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Company is not liable for any damages, including but not limited to lost profits, data loss, or other incidental damages arising from the use or inability to use the Software.

9. Termination

This agreement is effective until terminated. The Company may terminate this EULA if you violate its terms. Upon termination, you must cease using the Software and delete all copies.

10. Privacy Policy

By using the Software, you consent to the collection and use of your data in accordance with the Company's Privacy Policy.

11. Governing Law

This EULA and TOS shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

12. Amendments

The Company reserves the right to amend these terms at any time. Continued use of the Software after amendments constitutes acceptance of the updated terms.
